Commission addresses legal issues with previously applied five-year anti-dumping and countervailing duties on imports from China
Brussels – The European Commission (EC) has reimposed anti-dumping duties (see table below) on imports of new and retreaded truck & bus tires originating from China, which were originally applied on 4 May 2018.
In May 2022, the European General Court ruled that the Commission’s five-year anti-dumping and countervailing duties on imports of truck & bus tires from China must be annulled.
The EC, it found, had not carried out fair price comparisons in calculating price-undercutting in a case brought by the China Rubber Industry Association (CRIA) and China Chamber of Commerce of Metals, Minerals & Chemicals Importers & Exporters.
The Brussels regulator, on 7 July 2022, re-opened its anti-dumping and anti-subsidy investigations concerning Chinese truck and bus tires to address “illegalities” identified by the European General Court.
The trade measures were introduced 4 April following detailed, company-by-company analyses of import volumes, selling prices and other aspects of EU anti-dumping and countervailing duty investigations.
