Sinorgchem appeals ITC antidegradants ruling
Washington -- Sinorgchem Co. has petitioned the US Federal Circuit appeals court for an appeal of the International Trade Commission's order forbidding the Chinese chemical manufacturer or its US sales agent, Sovereign Chemical Co., to sell rubber antidegradant 6PPD and its feedstock 4-ADPA in the US.
The ITC found in July that Sinorgchem used Flexsys´s patents for making 6PPD and 4-ADPA without Flexsys´s permission.
Manni Li, a Washington lawyer representing Sinorgchem, said Sinorgchem has so far filed only a notice of appeal with the Federal Circuit court, with a brief to follow.
Flexsys, meanwhile, continues its $20 million lawsuit against Sinorgchem, Sovereign and Kumho Tire Co. for alleged patent infringement based on the ITC ruling.
