Shell, Dow, Unipetrol appeal against rubber fines--update
Brussels -- Makers of synthetic rubber are appealing against the fines imposed by the EU last year.
The report quotes spokeswomen for both Shell and Dow saying that both companies filed appeals on February 16 with the European Court of First Instance in Luxembourg, the EU's second-highest court. A spokesman for Shell confirmed that the company has lodged an appeal in that court on 16 Feb. He added that Shell Nederlands has admitted participation in the cartel, but said the company is appealing against the size of the fine, not against the judgement of guilt.
The spokesman said Shell has previously appealed against other judgments, some of which were succesful in reducing the level of fine. The spokesman said Shell is acting on its own and it is not involved in discussions with other companies who might be appealing against their own fines.
Bloomberg also quoted Mario Siragusa, a lawyer for ENI, saying the company expects to place the appeal in the next day or two.
In November, the EU levied fines totalling Euro 519 million on Shell, Eni Dow, Unipetrol AS and Poland's Trade-Stomil Sp z o.o. after finding that the companies had cooperated on pricing in SBR.
