Flexsys expects decision in 6PPD litigation at year-end
Ohio -Â The on-going legal battle between Flexsys America LP and its competitor Sinorgchem is expected to reach another stage by the end of the year. Flexsys said the appeal by Sinorgchem of a decision by the US International Trade Commission (ITC) is "proceeding toward final status as expected."
In a statement, Flexsys said, "The written briefs are all completed and oral arguments will be scheduled soon. A decision is expected from the Court of Appeals in approximately six or seven months.
Flexsys claims Sinorgchem is in breach of its patents on the process for making an intermediate chemical called 4?aminodiphenylamine (4-ADPA). It is further claiming damages against customers of Sinorgchem, who use 4-ADPA to make PPD-based materials including 6PPD. And further claiming damages against tyremakers who use the 6PPD as an anti-degradent in the manufacture of their products and subsequently import those products to the US.
