ERJ staff report (DS)
Oklahoma City, Oklahoma -- Local newspapers are reporting that Continental Carbon has lost a court case in Oklahoma and been forced to pay a settlement of around $10.5 million to the Ponca Tribe of Native Americans
Native American magazine published a statement, apparently approved by the United States District Court for the Western District of Oklahoma. The statement says, "A settlement has been proposed in the Class Action lawsuit, Ponca Tribe of Indians, et al. v. Continental Carbon Company, et al., Case No. 05-445 (W.D. Okla.) (Judge Cauthron Presiding). The settlement will provide $10,500,000.00 to settle claims of Enrolled Tribal Members."
In 2007, the Ponca Tribe issued proceedings against Continental Carbon Company, CCC USA, Inc., and China Synthetic Rubber Corp., alleging pollution to their properties for emitting carbon black and pollutants.
The statement further adds, "On February 6, 2009 the Class Representatives and the Defendants reached an agreement." The satement then goes on to give details of the proposed settlement.
