Court throws out bid to take Goodyear runflat case to class action

New York -- A US Federal court has denied a claimant's bid to convert a lawsuit claiming damages over Goodyear's runflat tyres fitted to the BMW Mini Cooper S model to a class action.
Claimant Gerarld Oscar (“Oscarâ€) brought an actaion against BMW of North
America, LLC (“BMWâ€) alleging that the Goodyear run-flat tyres (“RFTsâ€) with which his 2006
MINI Cooper S was equipped were defective. Oscar wanted to change the action to a class action, but the courts denied this request.
Oscar filed this suit on January 5, 2009 against BMW and Goodyear Tire & Rubber
Company, Inc. (“Goodyearâ€). On June 5, 2009, BMW moved to dismiss certain counts of
Oscar's complaint, and Goodyear moved to dismiss the complaint against Goodyear in its
entirety.
