DuPont wins $919m aramid IP case against Kolon: Kolon to appeal
ERJ staff report (DS)
Wilmington, Delaware -- DuPont said it has won a civil lawsuit for $919.9 million against Kolon Industries, with the jury finding that Kolon stole trade secrets and confidential information regarding DuPont aramid fibre known as Kevlar. Kolon, a South Korea-based company, was found liable for misappropriation of trade secrets, and the jury found that its actions were willful and malicious.
Kolon said it will appeal. In a statement, the Korean company said, "Although Kolon respects the decision rendered by the Eastern District of Virginia jury, it disagrees with the verdict and is confident that a fair and favourable decision will be reached on appeal." Kolon added that it, "will continue to vigorously prosecute its antitrust action against DuPont, which is scheduled to be tried in March 2012."
DuPont said it will ask the trial judge to impose injunctive relief requiring Kolon to return DuPont's proprietary information and to stop manufacturing and selling products made from that information. DuPont also expects to recover its attorney's fees from Kolon
