Washington — The US National Highway Traffic Safety Administration (NHTSA) has granted the petition of Continental Tire the Americas LLC for a finding of inconsequential noncompliance in the case of 116,500 mismarked passenger tires.
The tires involved were Continental ExtremeContact DW tires, size 225/45R17 91W; Continental ExtremeContact DWS tires, size 225/45R17 91W; and General G-Max AS-03 tires, size 225/45R17 91W.
The sidewall markings on the tires do not correctly describe the actual number of plies in the tread area of the tires, Conti told NHTSA.
The tire maker argued that the errors were inconsequential to tire safety. The mislabeling has no impact on the performance of the tires or the safety of vehicles equipped with them, Conti said.
The company also said it is unaware of any accidents or injuries caused by the mislabeling, and noted that NHTSA has granted similar petitions in the past.
NHTSA agreed with Conti, and in a Federal Register notice on 11 June granted the tire maker’s petition.
The grant of inconsequential noncompliance means Conti will not have to conduct a formal recall of the tires. Conti told NHTSA that it has already corrected the error.
NHTSA’s most recent grant of inconsequential noncompliance to Conti was 2 June, when the agency granted Conti’s petition regarding 814 General Altimax RT43 replacement tires for erroneous maximum air pressure markings.
